UAE - Would DIFC assume Jurisdiction over IP Disputes?

On October 31, 2011, His Highness Sheikh Mohamed Bin Rashid Al Maktoum, Vice President of U.A.E. and Ruler of Dubai Emirate, issued a new decree giving all types of business establishments the right to use the special court system of Dubai Intellectual Financial Center (DIFC) for settlement of commercial disputes. The DIFC was established in 2004 as a free zone with special court system. Prior to the present decree, the jurisdiction of the DIFC was limited to commercial disputes involving the DIFC itself any of its bodies or establishments operating within it.

UAE - TradeSecrets Law Underway

Although the U.A.E. Cabinet has approved the plans raised for drafting a tradesecret law since early 2011, this law is yet to be enacted. However, there is information that a draft law has been made and is being reviewed by the various government departments concerned before it will be forwarded to the Cabinet and National Federal Assembly for approval.

UAE - New System and Procedure for Trademark Matters

The U.A.E. Trademark Office has recently adopted an electronic new system for handling and managing trademark transactions. The new system is based on the WIPO trademark registration software IPAS and it will be used by the office for managing all trademark registration formalities. On March 28, 2012, the Trademark Office held a gathering for representatives of active trademark agents in U.A.E., during which the new system was introduced and demonstrated.

So far the new system does not have the facility of an e-filing procedure. However, there is information that this facility may be added to the system in the future when certain technical requirements are connected to the system.

UAE - Nice Classification 10th Edition Adopted

The U.A.E. Trademark Office has recognized and adopted the 10th Edition of Nice International Classification of Goods and Services. The office has started implementing the new edition with effect from January 1st, 2012.

The changes which WIPO has made in the 10th Edition descriptions of certain classes has accordingly been applied by the U.A.E. Trademark Office for the applications filed since January 1st, 2012.
